
Terms and Conditions
Acceptance
It is not necessary for the Client to have signed any document for these terms and conditions to apply. If the Client commissions artwork or shops from Martin Brennan aka Martin Brennan Art then the Client will be deemed to have satisfied themselves as to the terms applying and have accepted these terms and conditions in full.
Please read these terms and conditions carefully. Any commission or use services implies that you have read, understood and accepted these terms and conditions.
Description of Product (Painting):
The painting will be produced on a high quality stretched canvas (thickness specified before starting). The finished product will be protected from dirt, dust and UV damage using a strong high-quality varnish. The work will be based on either a photo to recreate or a description of the abstract agreed on at the time of quotation before payment, we will work together to find the most appropriate photo for the painting, however the artist has the right to turn down the commission if a good quality photo cannot be provided.
Photograph Rights:
Reference photos that aren’t owned by the client themselves must obtain permission from the owner of the photo. The same applies for if the photograph was taken by a professional photographer, permission must be granted.
Payment:
Prices are subject to change, however once the 50% deposit non refundable has been paid the price is fixed.
Payment can be made via website or payment link supplied, I require a 50% deposit to secure your booking or reservation of original artwork which is a non-refundable deposit. Once the artwork has been completed, the final payment of the remaining 50% will need to be paid within 30 days before the artwork will be shipped out. For original artwork, if the final payment isn’t received within the 30 days, the artwork will go back on the market for sale and deposit will not be refunded. If the piece is commissions and the client isn’t happy with the artwork, and it cannot be resolved with minor alterations, then the final payment will not need to be paid, however the client will not receive the artwork. If the artwork is deemed acceptable for public sale it will go on the market, for example a painting of an animal with no personal images included.
Target Dates:
Before any artwork is started, a target date for the completion of the art will be agreed. The client will be notified once the product has been dispatched, from the point the length of time it takes to arrive is no longer the artist’s
responsibility.
Delivery of the Product:
The product will be posted via tracked delivery from the UK. The client will be given a tracking number, and the product will be shipped in protective packaging. Overseas delivery charges will be added on to the balancing payment.
Returns:
Returns are not accepted unless the product has been damaged prior to the client receiving it before its been collected by the delivery company. The client must get in touch within 24 hours of receiving the product if this is the case. The cost of postage when returning any damaged products is the responsibility of the client.
Copyright:
The artist retains the copyright of the work, so therefore has the right to use an image of the work for portfolios, this website and social media. However, for privacy reasons, permission from the client will be required before publishing people portraits. The client does not have the right to sell copies of the work in any way without permission from the artist.
Data Protection:
The artist will need to collect the following information: the client’s name, email address and address. This information will only be used to send invoices and to deliver the product. The client’s name will be stored to keep track of orders. Once the client has received the product, records of email addresses and addresses will be deleted. Any photos that have been saved or printed will also be deleted or destroyed.
Artwork Progress:
Once work commences on the clients portrait, photos of the progress will be sent to the client, at this stage minor alterations can be made to its design content.
Martin Brennan Art reserves the right to share “art in progress” photos on social media unless the client expresses this not to be done, for example a surprise gift.
If the commission is stated as a gift, then no images of the piece will be published until the gift is received.
